AN INTRODUCTION TO DISABILITY LAW


The guest lecture was graced by Adv. Akshay Jain, who specializes in Human Rights and Criminal Laws. With his enthusiasm and interest in Human Rights and Disability Rights, he believes in inclusion for all. His address was open for all UG and PG students from the School of Law at the Auditorium on 21st April, 2023, from 09:40 AM onwards. The lecture was an attempt to advocate for the rights of persons with disability along with increasing public awareness and sensitivity. The Guest Lecture conducted gave an overview of Disability laws to the target audience. The guest highlighted the below-mentioned concerns and issues during the discourse:

Types of Disabilities, Impairments, and Rights: The lecture provided an in-depth understanding of various types of disabilities recognized under the law, including physical, sensory, intellectual, and mental disabilities. The rights of persons with disabilities, such as the right to education, healthcare, employment, and social security, were discussed in detail.

Accessibility and Reasonable Accommodation: The lecture emphasized the importance of accessibility for persons with disabilities and the concept of reasonable accommodation, along with the concept of equity, which entails making necessary modifications and adjustments to ensure that persons with disabilities can participate fully in all aspects of life. The lecture highlighted the obligations of the government, private organizations, and educational institutions to provide reasonable accommodation.


Role of Institutions and Organisations: The lecture discussed the role of various institutions and organizations in implementing disability laws in India, including the central and state governments, the National Commission and State Commissions for Persons with Disabilities, and non-governmental organizations (NGOs). The lecture also highlighted the role of civil society in advocating for the rights of persons with disabilities.

Overview of Disability Laws in India: The lecture also enlightened the law aspirants with an overview of disability laws in India, including the Rights of Persons with Disabilities Act, 2016, which replaced the earlier Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. The lecture highlighted the Act’s key provisions, including non-discrimination, accessibility, education, employment, and social protection.

Increased Awareness: The lecture enhanced students’ awareness of disability laws in India. Many students expressed that they were not aware of the comprehensive legal framework and provisions related to disability rights in the country. The lecture helped them understand the importance of disability laws in promoting inclusivity and ensuring equal opportunities for persons with disabilities.

Understanding of Key Concepts: The lecture provided a clear understanding of key concepts such as non-discrimination, accessibility, reasonable accommodation, and the types of disabilities recognized under the law. Students gained insights into the practical implications of these concepts in various domains, such as education, employment, and social protection.

Sensitization and Empathy: The lecture sensitized students towards the challenges faced by persons with disabilities and instilled empathy in them. Students learned about the barriers faced by persons with disabilities in accessing education, employment, and other opportunities, and the lecture encouraged them to think critically about ways to promote inclusivity and accessibility in their future professions.


Inspiration for Further Study and Advocacy: The lecture inspired several students to pursue further study and research in the field of disability laws and advocacy. Students expressed their interest in learning more about the legal framework, policy implementation, and challenges faced by persons with disabilities in India. Some students also expressed their desire to work as advocates for disability rights in their future careers.
